Fakta:
Unita Sanitaria Locale (USL) RM/24 of Monterotondo (Rome), a local health authority, laid down rules governing tendering procedure for suturing material.. The company Laboratori Bruneau SRL wanted to make a bidding, but was excluded from the tendering procedure because it did not fulfil the conditions of Law No. 64/86. Under this law the Italian State extended to all public bodies, authorities, and bodies and companies in which the State had a shareholding, the obligation to obtain at least 30% of their supplies from industrial, agricultural and small craft undertakings established in Mezzogiorno (southern Italy). Laboratori Bruneau had no branch office or factory in Mezzogiorno. The company submitted a bidding and as this was not accepted, it petitioned the Tribunale Amministrativo Regionale del Lazio to determine whether the tendering procedure was illegal as the Italian legislation violated Community law. The national court requested the European Court to give a preliminary ruling (under Art. 177 of the EC Treaty) on whether Arts. 30 and 92 of the EC Treaty were to be so construed that a national rule reserving a percentage of public supply contracts to undertakings located in certain regions of the national territory constitutes "measures of equivalent effect to quantitative restrictions" or "aids" and whether they preclude rules like the Italian.

Názor soudu a komentář:
The Court had already given an answer, shortly before in another case of the same nature (
Du Pont de Nemours
) and thus can refer to its holding. Thus, Art. 30 precludes a national rule which reserves a percentage of public supply contracts to undertakings established in a particular region of the national territory. As for whether the Italian law might be regarded as aid within the meaning of Art. 92 of the EC Treaty, this is not relevant since even rules that are aid within the meaning of Art. 92 cannot be exempted from the prohibition set out in Art. 30.
