Fakta:
Od roku 1965 byla v Itálii aplikována spotřební daň na čerstvé banány, která byla postupně několikrát zvýšena. Firma Chiquita Italia, dovážející banány mimo jiné z Kolumbie a Svaté Lucie, odmítla platit zmíněnou daň s poukazem na fakt, že daň je v rozporu s ustanoveními GATT a Konvencemi z Lomé, podepsanými mezi ES a africkými
, karibskými a pacifickými státy
Zatímco národní soud nespecifikoval, ke které z Loméských konvencí se otázka vztahuje, ESD vy
jasňuje, že otázka musí být řešena v souvislosti se 4 Konvenci z Lomé (OJ 1991 L 229) a s protokolem č. 5 o banánech (OJ 1991 L 1991). Pokud není dále uvedeno jinak, tento text se odvolává právě na řečené dokumenty.

V průběhu řízení mezi firmou Chiquita a italským ministerstvem financí o zákonnosti daně, obvodní soud v Trieste přerušil řízení a v souladu s čl. 177 Smlouvy ES předložil případ ESD s otázkami:
1. zda smlouva GATT a konv
ence z Lomé obsahují ustanovení takové povahy, aby zakládala práva jednotlivců, jichž by bylo možné se dovolat u národních soudů.
2. zda italská spotřební daň byla v rozporu s řečenými mezinárodními smlouvami.
From 1965, Italy applied a tax on the consumption of fresh bananas which was increased several times over the years. Chiquita Italia, which imported bananas
inter alia from Columbia and Saint Lucia refused to pay the said tax, contending that it was contrary to the provisions of the General Agreement on Trade and Tariffs (GATT) and of the Conventions signed at Lomé between the African, Carribean and Pacific States and the European Economic Community (“the ACP-EEC Conventions”
While the national court making the reference had not specified which of the ACP-EEC Conventions its questions related to, the Court ascertains that, pursuant to the facts of the case, the questions must be read as referring to the Fourth ACP-EEC Convention, signed at Lomé on 15 December 1989 (OJ 1991 L 229, p. 1) and to Protocol No 5 on bananas (OJ 1991 L 229, p. 213). Unless indicated otherwise, the following text refers to this Fourth Convention only.

In proceedings between Chiquita Italia and the Ministry of Finance concerning the validity of the Italian consumption tax, the Tribunale di Trieste (District Court, Trieste) stayed the pro ceedings and under Article 177 of the Treaty referred to the Court of Justice the questions (1) whether the GATT and the ACP-EEC Conventions contained provisions of such a nature as to confer rights on individuals which they may enforce in national courts and (2) whether the Italian consumption tax was compatible with said international agreements.


Názor soudu a komentář:
Otázka přímé účinnosti ustanovení obsažených ve smlouvě uzavřené mezi Společenstvími a třetími státy (nečlenskými) vyžaduje hodnocení povahy, obecných rysů a podmínek této smlouvy /IFC/. Co se týče prvého kroku, bylo dovozeno, že předmětná smlouva v podstatě zakládá práva jednotlivců. V druhém kroku bylo nutno dovodit, která ustanovení jsou dostatečně jasná, určitá a bezpodmínečná a mohou být tedy přímo účinná. V souladu se svou dřívější judikaturou /případ 280/93/ soud konstatuje, že GATT není přímo aplikovatelný. GATT je charakterizován značnou flexibilitou ponechávající prostor pro různé výjimky a derogace, speciální procedurou pro řešení sporů, která umožňuje jejich individuální řešení, jež se mohou odlišovat od základních pravidel GATT. Tento systém by mohl být ohrožen, pokud by se jednotlivé subjekty mohly dovolávat ustanovení GATT před národními soudy.
Na druhou stranu čtvrtá konvence z Lomé, může dle předchozí interpretace ESD ohledně dřívějších konvencí /Bresciani/ obsahovat ustanovení, jíž se jednotlivci mohou dovolat. Za použití poněkud vágních termínů soud uvádí, že konvence z Lomé nemají stejnou povahu jako GATT. GATT je charakterizován značným nepoměrem závazků přijatých smluvními stranami, ani tento nepoměr ani speciální procesní úprava řešení sporů nepředjímá, podle názoru soudu, uznání přímé účinnosti některých ustanovení GATT, i když jsou dostatečně jasná, precizní a bezpodmínečná. Konvence z Lomé vylučuje zvyšování vnitřních daní na banány, pocházející ze smluvních států, pokud zvýšení bylo uvaleno po 1. 4. 1976 a jejichž efektem je zhoršení exportní situace vzhledem k přístupu na tradiční trhy. Zatímco tento závěr nemůže být podložen čl. 177 (2) či 169 (1) Konvence, lze jej vyvodit z čl. 1 protokolu č5.
Ve vztahu k vývozu banánů na trhy ES žádný ze smluvních států Konvence nemá mít obtížnější přístup na své tradiční trhy, nežli v minulosti nebo v současnosti.
Chiquita s odvoláním na dřívější rozhodnutí ESD ohledně článku 95 Smlouvy ES, argumentovala, že článek 177 odst. 2) Konvence se vztahuje též na vnitřní zdanění, které má být tudíž zakázáno. Soud neakceptuje toto stanovisko, s odvoláním na vlastní analýzu znění a kontextu článku 177 (2), který není srovnatelný s článkem 95 Smlouvy ES. Stejně tak soud odmítá argument, že článek 169 odst.1 Konvence – korespondující s článkem 30 Smlouvy ES – vylučuje předmětné zdanění. "… jak vyplývá z ustálené judikatury ESD rozsah výkonu
smlouvy ES a podobných či dokonce identických ustanovení dohod uzavíraných se třetími státy závisí mimo jiné na účelu každého ustanovení v jeho zvláštním kontextu". Komparace textu smlouvy ES a dohod s třetími státy musí být činěna zvláště s tímto zřetelem /Metalsa, Polydor/. Soud uzavírá, že v případě absence specifických ustanovení, týkajících se vnitřního zdanění v Konvenci, nebylo intencí smluvních stran Konvence tuto oblast regulovat v rámci obecných obchodních opatření. Spotřební daň je však neslučitelná s čl. 1 Protokolu 5. Toto ustanovení je formulováno jasně, určitě a bezpodmínečně a je tudíž přímo aplikovatelné. Doložka stálosti vylučuje zvyšování daní ( i spotřebních daní), jelikož takové zvyšování vede ke zvýšení cen banánů a tím je činí hůře prodejnými na určeném trhu. Jelikož stejné ustanovení již bylo obsaženo v dřívějších Konvencích z Lomé ( první vstoupilo v platnost 1. 4. 1976) – zvyšování daní je nepřípustné od tohoto data.
“[T]he question of the direct effect of provisions contained in an agreement concluded by the Community with non-member countries invariably involves an examination of the spirit, general scheme and terms of that agreement” ( [057]

). Only if, as a first step, this examination has established that the agreement in question, in principle, confers rights upon individuals is it possible, in a second step, to examine for each provision whether it is sufficiently clear, precise and unconditional so as to be directly applicable.
As the Court has consistently held (see Case 280/93) the GATT is not directly applicable. This agreement is characterized by a great flexibility leaving much room for derogations as well as a specific procedure for settling disputes which are open to individual solutions which may deviate from the basic rules of the GATT. This system would be jeopardized could individuals invoke the provisions of the GATT before the national courts of a Member State.
The Fourth ACP-EEC Convention on the other hand may, as the Court has already held with respect to preceding Conventions ( [108] Bresciani), contain provisions that individuals can rely upon. In somewhat vague terms, the Court notes that the ACP-EEC Convention “is not of the same nature as the GATT”. While it is characterized by “a quite appreciable imbalance in the level of obligations undertaken by the contracting parties”, neither this imbalance nor the special procedure for settling disputes between the contracting parties precludes, in the Court’s view, the recognition of a direct effect of some of its provisions which are sufficiently clear and precise and unconditional.
The ACP-EEC Conventions preclude increases in internal taxation on bananas originating from the ACP-EEC States where those increases take place after 1 April 1976 and their effect is to place those banana exports in a situation less favourable then before, as regards access to their traditional markets. While this conclusion cannot be based on Article 177(2) or Article 169(1) of the Fourth ACP-EEC Convention, it follows from Article 1 of Protocol No 5 Article 1 provides: “In respect of its banana exports to the Community markets, no ACP State shall be placed, as regards access to its traditional markets, in a less favourable situation than in the past or at present.”
. Chiquita had, relying on the Court’s case law regarding Article 95 of the Treaty, argued that Article 177(2) of the Fourth ACP-EEC Convention related to internal taxation and thus prohibited the consumption tax in issue. The Court does not accept this argument, since following the Court’s analysis of the wording and context of the provision, Article 177(2) is not a provision comparable to Article 95 of the Treaty. Neither does the Court accept that Article 169(1) of the Fourth ACP-EEC Convention, which corresponded to Article 30 of the Treaty, prevents such consumption tax as that in issue: “It follows from the settled case-law of the Court that the extension of the interpretation of a provision in the Treaty to a comparably, similarly or even identically worded provision of an agreement concluded by the Community with a non-member country depends inter alia on the aim pursued by each provision in its particular context and that a comparison between the objectives and context of the agreement and those of the Treaty is of considerable importance in that regard”
( Metalsa; [259] Polydor). The Court concludes from the absence of specific provisions relating to internal taxation that the parties to the agreement did not intend to regulate that matter within the framework of the general trade arrangements.
The consumption tax is incompatible, thouhg, with Article 1 of Protocol No 5. This provision is worded in clear, precise and unconditional terms and thus directly applicable. The standstill clause contained therein precludes increases in a tax such as the consumption tax in issue because such increases lead to increases in the price of the bananas concerned and, accordingly, make it more difficult to sell them on the market in question. Since the same provision was already contained in the preceding ACP-EEC Conventions, the first of which entered into force on 1 April 1976, increases in the consumption tax precluded as of that date.
