If by reason of imports or exports the Community market in one or more of the products listed in Article 1 experiences or is threatened with serious disturbances which may endanger the objectives set out in Article 39 of the Treaty, appropriate measures may be applied in trade with third countries until such disturbance or threat of disturbance has ceased.

Si, dans la Communauté, le marché d'un ou de plusieurs des produits visés ŕ l'article 1er subit, ou est menacé de subir, du fait des importations ou des exportations, des perturbations graves susceptibles de mettre en péril les objectifs de l'article 39 du traité, des mesures appropriées peuvent ętre appliquées dans les échanges avec les pays tiers jusqu'ŕ ce que la perturbation ou la menace de perturbation ait disparu.

Wird der Markt in der Gemeinschaft für eines oder mehrere der in Artikel 1 genannten Erzeugnisse auf Grund von Einfuhren oder Ausfuhren ernstlichen Störungen ausgesetzt oder von ernstlichen Störungen bedroht, die die Ziele des Artikels 39 des Vertrages gefährden könnten, so können im Handel mit dritten Ländern geeignete Maßnahmen angewandt werden, bis die tatsächliche oder die drohende Störung behoben ist.

Pokud je v důsledku dovozu nebo vývozu trh Společenství s jedním nebo více produkty uvedenými v článku 1 vážně narušen nebo hrozí-li, že bude vážně narušen, a tím budou ohroženy cíle stanovené v článku 39 Smlouvy, mohou být pro obchod se třetími zeměmi přijata vhodná opatření, dokud toto narušení nebo jeho hrozba trvá.

The Council, acting in accordance with the voting procedure laid down in Article 43 (2) of the Treaty on a proposal from the Commission, shall adopt detailed rules for the application of this paragraph and define the cases in which and the limits within which Member States may take protective measures.

Le Conseil, statuant sur proposition de la Commission selon la procédure de vote prévue ŕ l'article 43 paragraphe 2 du traité, arręte les modalités d'application du présent paragraphe et définit les cas et les limites dans lesquels les États membres peuvent prendre des mesures conservatoires.

Der Rat legt auf Vorschlag der Kommission nach dem Abstimmungsverfahren des Artikels 43 Absatz 2 des Vertrages die Durchführungsbestimmungen zu diesem Absatz fest und bestimmt, in welchen Fällen und innerhalb welcher Grenzen die Mitgliedstaaten Schutzmaßnahmen treffen können.

Rada stanoví na návrh Komise postupem podle čl. 43 odst. 2 Smlouvy prováděcí pravidla k tomuto odstavci a určí, v jakých případech a v rámci jakých mezí mohou členské státy přijmout ochranná opatření.

If the situation mentioned in paragraph 1 arises, the Commission shall, at the request of a Member State or on its own initiative, decide upon the necessary measures ; the measures shall be communicated to the Member States and shall be immediately applicable. If the Commission receives a request from a Member State, it shall take a decision thereon within twenty-four hours following receipt of the request.

Si la situation visée au paragraphe 1 se présente, la Commission, ŕ la demande d'un État membre ou de sa propre initiative, décide des mesures nécessaires qui sont communiquées aux États membres et qui sont immédiatement applicables. Si la Commission a été saisie d'une demande d'un État membre, elle prend une décision ŕ ce sujet dans les vingt-quatre heures qui suivent la réception de la demande.

Tritt die in Absatz 1 erwähnte Lage ein, so beschließt die Kommission auf Antrag eines Mitgliedstaats oder von sich aus die erforderlichen Maßnahmen ; diese werden den Mitgliedstaaten mitgeteilt und sind unverzueglich anzuwenden. Ist die Kommission mit einem Antrag eines Mitgliedstaats befasst worden, so entscheidet sie hierüber innerhalb von vierundzwanzig Stunden nach Eingang des Antrags.

Pokud nastane situace uvedená v odstavci 1, rozhodne Komise na žádost členského státu nebo z vlastního podnětu o nezbytných opatřeních; opatření jsou sdělena členským státům a jsou okamžitě použitelná. Pokud členský stát předloží Komisi žádost, Komise přijme rozhodnutí do 24 hodin od jejího obdržení.

The measures decided upon by the Commission may be referred to the Council by any Member State within three working days following the day on which they were communicated. The Council shall meet without delay. It may amend or repeal the measures in question in accordance with the voting procedure laid down in Article 43 (2) of the Treaty.

Tout État membre peut déférer au Conseil la mesure prise par la Commission dans le délai de trois jours ouvrables suivant le jour de la communication. Le Conseil se réunit sans délai. Il peut, selon la procédure de vote prévue ŕ l'article 43 paragraphe 2 du traité, modifier ou annuler la mesure en cause.

Jeder Mitgliedstaat kann dem Rat die Maßnahmen der Kommission binnen einer Frist von höchstens drei Arbeitstagen nach dem Tag ihrer Mitteilung vorlegen. Der Rat tritt unverzueglich zusammen. Er kann die betreffende Maßnahme nach dem Abstimmungsverfahren des Artikels 43 Absatz 2 des Vertrages ändern oder aufheben.

Opatření, o kterých rozhodne Komise, může kterýkoli členský stát do tří pracovních dnů ode dne jejich sdělení předložit Radě k přezkoumání. Rada se sejde neprodleně. Hlasovacím postupem podle čl. 43 odst. 2 Smlouvy může dotyčná opatření změnit nebo zrušit.

Save as otherwise provided in this Regulation, Articles 92,93 and 94 of the Treaty shall apply to the production of and trade in the products referred to in Article 1.

Sous réserve des dispositions contraires du présent rčglement, les articles 92,93 et 94 du traité sont applicables ŕ la production et au commerce des produits visés ŕ l'article 1er.

Vorbehaltlich anderslautender Bestimmungen dieser Verordnung sind die Artikel 92 bis 94 des Vertrages auf die Herstellung der in Artikel 1 genannten Erzeugnisse und den Handel mit diesen Erzeugnissen anwendbar.

Nestanoví-li toto nařízení jinak, vztahují se na produkci produktů uvedených v článku 1 a obchod s nimi články 92, 93 a 94 Smlouvy.

When a substantial price rise is recorded on the Community market and this situation is likely to continue, thereby disturbing or threatening to disturb the market, the necessary measures may be taken.

Lorsqu'il est constaté sur le marché de la Communauté une hausse sensible des prix, que cette situation est susceptible de persister et que, de ce fait, ce marché est perturbé, ou menacé d'ętre perturbé, les mesures nécessaires peuvent ętre prises.

Wird auf dem Markt der Gemeinschaft eine erhebliche Preiserhöhung festgestellt und ist damit zu rechnen, daß diese Lage andauert und dadurch Marktstörungen auftreten oder aufzutreten drohen, so können die erforderlichen Maßnahmen ergriffen werden.

Pokud je na trhu Společenství zjištěn podstatný nárůst (nebo pokles) cen a je pravděpodobné, že tato situace bude pokračovat, a je-li tím trh narušen nebo hrozí-li, že bude narušen, mohou být přijata nezbytná opatření.

Tariff quotas for the products listed in Article 1 resulting from agreements concluded in the framework of the Uruguay Round trade negotiations shall be opened and administered in accordance with detailed rules adopted under the procedure laid down in Article 23.

Les contingents tarifaires pour les produits visés ŕ l'article 1er découlant des accords conclus dans le cadre des négociations commerciales du cycle d'Uruguay sont ouverts et gérés selon les modalités arrętées selon la procédure prévue ŕ l'article 23.

Die Zollkontingente für die in Artikel 1 genannten Erzeugnisse, die sich aus den im Rahmen der multilateralen Handelsverhandlungen der Uruguay-Runde geschlossenen Übereinkünften ergeben, werden nach den gemäß dem Verfahren des Artikels 23 festgelegten Modalitäten eröffnet und verwaltet.

Celní kvóty pro produkty uvedené v článku 1 vyplývající z dohod uzavřených v rámci Uruguayského kola obchodních jednání se otevírají a spravují podle prováděcích pravidel stanovených postupem podle článku 23.

Quotas may be administered using one of the following methods or by a combination thereof:

Zur Verwaltung der Kontingente kann eines der nachstehenden Verfahren oder eine Kombination dieser Verfahren angewandt werden:

- method based on the order in which applications are submitted (on a 'first come, first served` basis),

- méthode fondée sur l'ordre chronologique d'introduction des demandes (selon le principe du "premier venu, premier servi"),

- Berücksichtigung der Anträge in der Reihenfolge ihres Eingangs ("Windhund-Verfahren");

- způsob založený na časovém pořadí podaných žádostí (podle zásady “kdo dřív přijde, je dřív na řadě”),

- method allocating quotas in proportion to the quantities requested when applications are submitted (using the 'simultaneous examination` method),

- méthode de répartition en proportion des quantités demandées lors de l'introduction des demandes (selon la méthode dite "examen simultané"),

- Aufteilung proportional zu den bei der Antragstellung beantragten Mengen (sogenanntes "Verfahren der gleichzeitigen Prüfung");

- způsob rozdělování kvót úměrně k požadovaným množstvím v době podání žádostí (tzv. způsob “souběžného zkoumání”),

- method based on traditional trade flows (using the 'traditional/new arrivals` method).

- méthode fondée sur la prise en compte des courants d'échanges traditionnels (selon la méthode dite "traditionnels/nouveaux arrivés").

- Berücksichtigung der traditionellen Handelsströme (sogenanntes "Verfahren traditionelle/neue Antragsteller").

Other appropriate methods may be adopted. They must avoid any discrimination between the operators concerned.

D'autres méthodes appropriées peuvent ętre établies. Elles doivent éviter toute discrimination entre les opérateurs intéressés.

Weitere geeignete Verfahren können festgelegt werden. Bei den Verfahren muß gewährleistet sein, daß die betreffenden Wirtschaftsteilnehmer nicht untereinander diskriminiert werden.

Mohou být stanoveny i jiné vhodné způsoby. Tyto způsoby nesmí vést k jakékoli diskriminaci mezi dotčenými hospodářskými subjekty.

The method of administration adopted shall, where appropriate, give due weight to the supply requirements of the Community market and the need to safeguard the equilibrium of that market.

La méthode de gestion établie tient compte, oů cela s'avčre approprié, des besoins d'approvisionnement du marché de la Communauté et de la nécessité de sauvegarder l'équilibre de celui-ci.

Mit dem festgelegten Verwaltungsverfahren wird gegebenenfalls dem Versorgungsbedarf des Gemeinschaftsmarkts und dem Erfordernis der Erhaltung des Gleichgewichts auf dem Gemeinschaftsmarkt Rechnung getragen.

Přijatý způsob správy vezme v případě potřeby v úvahu požadavky na zásobování trhu Společenství a nutnost zachovat rovnováhu tohoto trhu.

The general rules for the interpretation of the Common Customs Tariff and the special rules for its application shall apply to the tariff classification of products covered by this Regulation ; the tariff nomenclature resulting from the application of this Regulation shall form part of the Common Customs Tariff.

Les rčgles générales pour l'interprétation du tarif douanier commun et les rčgles particuličres pour son application sont applicables pour la classification des produits relevant du présent rčglement ; la nomenclature tarifaire résultant de l'application du présent rčglement est reprise dans le tarif douanier commun.

Für die Tarifierung der unter diese Verordnung fallenden Erzeugnisse gelten die allgemeinen Tarifierungsvorschriften und die besonderen Vorschriften über die Anwendung des Gemeinsamen Zolltarifs ; das Zolltarifschema, das sich aus der Anwendung dieser Verordnung ergibt, wird in den Gemeinsamen Zolltarif übernommen.

Obecná pravidla pro výklad společného celního sazebníku a zvláštní pravidla pro jeho používání se použijí na zařazení produktů, na něž se vztahuje toto nařízení; celní nomenklatura vyplývající z používání tohoto nařízení se přejímá do společného celního sazebníku.

15.

Save as otherwise provided in this Regulation or where derogation therefrom is decided by the Council acting by a qualified majority on a proposal from the Commission, the following shall be prohibited:

Sauf dispositions contraires du présent rčglement ou dérogation décidée par le Conseil, statuant sur proposition de la Commission ŕ la majorité qualifiée, sont interdites:

Vorbehaltlich anderslautender Bestimmungen dieser Verordnung oder vorbehaltlich einer vom Rat auf Vorschlag der Kommission mit qualifizierter Mehrheit beschlossenen Ausnahme ist folgendes untersagt:

Nestanoví-li toto nařízení jinak nebo nerozhodne-li Rada na návrh Komise kvalifikovanou většinou o výjimce, je zakázáno:

- the levying of any customs duty or charge having equivalent effect,

18.

Any measure restricting the issue of import or export licences to a specified category of person shall be regarded as a measure having effect equivalent to a quantitative restriction.

Est considérée comme mesure d'effet équivalant ŕ une restriction quantitative, entre autres, la limitation ŕ une catégorie déterminée d'ayants droit de l'octroi de certificats d'importation ou d'exportation.

Als Maßnahmen mit gleicher Wirkung wie eine mengenmässige Beschränkung gilt unter anderem die Begrenzung der Erteilung von Einfuhr- und Ausfuhrlizenzen auf eine bestimmte Gruppe von Empfangsberechtigten.

Za opatření s účinkem rovnocenným množstevnímu omezení se mimo jiné považuje jakékoli opatření omezující vydávání dovozních nebo vývozních licencí určité skupině osob.
